This Acceptable Use Policy (“AUP”) governs your use of the ClinicCube healthcare management platform, including all websites, applications, APIs, and related services (collectively, the “Service”). This AUP is incorporated by reference into our Terms of Service.
By accessing or using the Service, you agree to comply with this AUP. We may update this policy at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Permitted Use
The Service is intended exclusively for:
- Licensed healthcare providers managing their clinical practices, scheduling appointments, maintaining patient records, and communicating with patients
- Patients booking appointments, accessing their health records, communicating with their healthcare providers, and managing their health information
- Clinic administrators managing operations, staff, billing, and reporting for their healthcare facilities
- Authorized staff members performing duties assigned by their healthcare organization
3. Prohibited Activities
You may not use the Service to:
3.1 Illegal and Harmful Activities
- Violate any applicable local, state, national, or international law or regulation
- Practice medicine without a valid and current professional license
- Prescribe, dispense, or recommend controlled substances in violation of applicable law
- Engage in healthcare fraud, including false billing or misrepresentation of services
- Facilitate or promote illegal drug use, drug diversion, or prescription abuse
- Engage in human trafficking, exploitation, or abuse of any kind
3.2 Data and Privacy Violations
- Access, collect, or store Protected Health Information (PHI) without proper authorization
- Share patient data with unauthorized third parties
- Attempt to de-anonymize or re-identify anonymized health data
- Violate HIPAA, GDPR, or any other applicable data protection regulations
- Harvest, scrape, or collect email addresses, names, or other personal information from other users
- Use patient data for marketing purposes without explicit consent
3.3 Security Violations
- Attempt to gain unauthorized access to any accounts, systems, networks, or data
- Transmit viruses, malware, ransomware, spyware, or other harmful code
- Conduct vulnerability scans, penetration tests, or security assessments without prior written authorization
- Interfere with or disrupt the Service, servers, or connected networks
- Attempt to bypass any security measures, authentication mechanisms, or access controls
- Use automated tools, bots, or scripts to access the Service except through our published APIs
- Engage in denial-of-service attacks or deliberately overload our infrastructure
3.4 Content Violations
- Upload, share, or transmit content that is defamatory, obscene, threatening, or harassing
- Post false medical credentials, qualifications, or reviews
- Distribute misleading health information that could endanger patient safety
- Infringe on any intellectual property rights, including copyrights, trademarks, or patents
- Impersonate any person or entity, or falsely state or misrepresent your affiliation
3.5 Platform Abuse
- Create multiple accounts to circumvent restrictions or bans
- Resell, sublicence, or redistribute access to the Service without authorization
- Use the Service for competitive analysis or to develop a competing product
- Reverse engineer, decompile, or disassemble any part of the Service
- Abuse the support system by filing false reports or making fraudulent claims
- Manipulate ratings, reviews, or feedback systems
4. Resource Usage Limits
To ensure fair use and maintain service quality for all users, the following limits apply:
- API Requests: Rate limits apply to all API endpoints. Exceeding limits may result in temporary throttling.
- Storage: File storage is subject to the limits of your subscription plan. Uploading excessively large or irrelevant files is prohibited.
- Bandwidth: Excessive bandwidth consumption that degrades service for other users may be restricted.
- Concurrent Sessions: The number of simultaneous sessions may be limited based on your subscription tier.
5. Clinic Website Subdomains
Clinics and healthcare providers who create a public-facing website on the ClinicCube platform are assigned a subdomain (e.g., your-clinic.cliniccube.org). The following rules apply:
- Subdomains must be used exclusively for legitimate healthcare practice websites
- Subdomain names must not impersonate other clinics, healthcare organizations, or government entities
- Content published on clinic subdomains must be accurate, professional, and compliant with healthcare advertising regulations
- Subdomains must not be used to host content unrelated to the healthcare practice
- We reserve the right to reclaim or reassign subdomains that violate this policy or are inactive for an extended period
6. Reporting Violations
If you become aware of any violation of this AUP, please report it immediately by contacting us at abuse@cliniccube.com. Include as much detail as possible, including:
- Description of the violation
- URLs or screenshots, if applicable
- Identity of the user or account involved, if known
- Any other relevant information
All reports are treated confidentially. We do not retaliate against users who report violations in good faith.
7. Enforcement
Violations of this AUP may result in one or more of the following actions, at our sole discretion:
- Warning: A written notice describing the violation and requesting corrective action
- Temporary Suspension: Temporary restriction of access to the Service pending investigation
- Account Termination: Permanent removal of the account and all associated data
- Legal Action: Referral to law enforcement authorities or initiation of legal proceedings
- Regulatory Reporting: Reporting to relevant healthcare regulatory bodies when patient safety is at risk
We may investigate suspected violations and cooperate with law enforcement or regulatory authorities in the prosecution of users who violate this AUP or applicable law.
8. Modifications
ClinicCube reserves the right to modify this Acceptable Use Policy at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after such notification constitutes acceptance of the updated policy.
